PRIVACY POLICY

Effective date: January, 2015


We at Mosyle Tecnologia S.A (headquarter established in Brazil) and Mosyle Corporation (subsidiary established in USA) (together simply called "Mosyle," "we," "us," "our”) are committed to respect and protect the privacy of your information, and we take it really seriously. By accessing or using the Services (including but not restricting all the websites, products, services and applications made available by Mosyle, specially the mobile apps Mosyle and Mosyle Pro, available at the Apple App Store and Google Play, the app Mosyle HUB available at https://hub.mosyle.com/download and the web console available at https://mosyle.com/mosyle), you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

Your use of Mosyle’s Services is at all times subject to the Terms of Service, which incorporates this Privacy Policy. This policy does not apply to websites or services of companies that Mosyle does not own or control, or to individuals that Mosyle does not employ or manage.

1. GENERAL PRIVACY POLICY COVERAGE

This Privacy Policy explains how Mosyle collects and uses information from its Services Users, including our treatment of personally identifiable information.

If you are not of legal age to form a binding contract (in many jurisdictions, this age is 18), you may only use the Services and disclose information to us with your parent’s or guardian’s express consent. Review this Privacy Policy with your parent or guardian and make sure you understand it.

We only collect personal information through the Services from a child under 13 where that student’s school or district has agreed (via the terms described in more detail in the Terms of Services) to obtain parental consent for that child to use the Services and disclose personal information to us, for the use and benefit of the learning environment. If you are a student under 13, please do not send any personal information about yourself to us if your school or district has not obtained this prior consent from your parent or guardian, and please do not send any personal information other than what we request from you in connection with the Services. If you believe that a student under 13 may have provided us personal information in violation of this paragraph, please contact us at privacy@mosyle.com.

If you are a student registrant and your parent or guardian has signed up for the Services with a login provided by your school or district, you understand that your parent or guardian can view all information within or associated with your Services account, including, without limitation, messages between you and your school, district or teachers, grades you received on assignments, notebooks, calendar and analytics.


2. INFORMATION COLLECTED

2.1. General Information
: We receive and store any information you knowingly enter on the Services, whether via computer, tablet, other device, or that you provide to us in any other way. This information may include, without limitation, Personal Information such as your name, email address, a profile picture, and any other information necessary for us to provide our Services.

If you are a representative of a school or district, you may be asked to provide necessary information to create the School’s or District’s account and to fulfill our commitment to them, such as name, address, telephone number, educational institution name and logo, position and email addresses.

To provide the Services and improve the learning process of our Users, we also record the details of User’s activity on the Services, such as all actions performed by the user in accessing the Services, including but not restricting the usage time of all functions, frequency of use, performance data and other. This data is used specially to the learning analytics tools and reports provides by Services.


2.2. MDM – Information Monitoring
: The information collected and controlled by the Mobile Device Management tool provided by Mosyle (“Mosyle’s MDM”) and managed by the controller’s application depends on the settings chosen by the School or District, and may include, but not restricting: (1) identification of the equipment and the user; (2) status of the SIM card; (3) MAC Addresses and tablet's Serial Number; (4) telephone number, signal strength, carrier, IMEI #, and other WWAN attributes; (5) first and last name and email address of the registered user on the device; (6) use of data through the WWAN interface (excluding content); (7) websites visited using the tablet; (8) the tracking of device's associated asset, including service plan and associated physical equipment; (9) monitoring of apps loaded on the device (excluding content); (10) monitoring and mapping in real-time of the GPS location, including analysis of location data and history; (11) remote management of mobile devices, including screen capture, lock screen and wipe the tablet.

The functionalities of the Mosyle’s MDM that allows mobile devices to be monitored and controlled operates in the background of the equipment. Individuals are notified that these actions can occur, but may not be aware when they are happening in real time. These information are available to our Schools and Districts through the web console. Some of the information collected by Mosyle’s MDM enables us to perform our support obligations.


2.3. Information’s Use:

2.3.1. School or District Account Information: Besides other specific cases described in this Policy, Mosyle may use the information collected from Schools or Districts account for the following purposes: (1) Provide information to trading partners, in order to enable the promotion of both Mosyle as the partner concerned; (2) Disclose summary information to strategic and business partners, obtained by combining data; (3) Creation of reports about the demographics and patterns of user behavior, in order, mainly, to the efforts to expand the customer base; (4) Conducting audits, research and analysis, to protect, maintain and improve our services, ensuring the technical functioning of our server and network, protecting the rights of Mosyle's property - as well as our Users -, and promoting the new products or services development.

In addition to the cases mentioned above, Mosyle will not disclose any account information, such as contacts or geographic location, to other organization, unless: (1) The School or District give to Mosyle explicitly, and specific, authorization; (2) To provide such information to our subsidiaries or affiliated companies; (3) We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce agreements applicable, including investigation of potential violations, (c) detect, prevent, or deal with issues of fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Mosyle, its Users or the public as required or permitted by law; (4) When making an inquiry, request or complaint that requires follow-up, share your information with others to fulfill their calling; and / or (5) if the Mosyle is involved in a merger, acquisition or sale of all or part of its assets, you will be notified by email and / or by a notice on our Site of any change in ownership or use of your account information.


2.3.2. Users’ Information:

Besides other specific cases described in this Policy, Mosyle may use the information collected from the Users for the following purposes: (1) responding to Users’, Schools’ or Districts’ requests for certain information and services; (2) customizing Users experience, and communication about the Services; (3) improve our services; (4) send notifications to Users via the Services (including but not restricting e-mail and Push Notification) between students, teachers, administrators, School, District and from Mosyle (“Notifications”). Web beacons may also be used in some of our e-mails to let us know which emails (and which links within those emails) have been opened by recipients, which allows us to gauge the effectiveness of our customer communications;

Apart from the cases mentioned, Mosyle will not disclose any information collected from the Users - contact, financial or geographic location - to any other organization, unless: (1) You give to Mosyle explicitly, and specific, authorization; (2) To provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf (they must agree to process such information based on our instructions and in compliance with this Privacy Policy and other security and confidentiality practices); (3) We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce agreements applicable, including investigation of potential violations, (c) detect, prevent, or deal with issues of fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Mosyle, its users or the public as required or permitted by law; (4) When making an inquiry, request or complaint that requires follow-up, share your information with others to fulfill their calling.

Mosyle has no direct relationship with the Users whose personal data are processed. A User who seeks access, or which seeks to correct, to amend or to delete an inaccurate data should go directly to the School or District whose he is affiliated to solve these issues.


2.4. Information’s Secure:

Your account information is kept confidential and secure via a unique username and a password that is selected by you. When you enter sensitive information (such as login credentials) we encrypt the transmission of that information using Secure Socket Layer (SSL) technology. You are responsible for keeping your username and password safe and confidential because they are the key to accessing the information held by Mosyle about you. If your device is accessible to or by others, you should log out of the Mosyle’s Services whenever you leave your device. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of User information.


3. Changes and Updates to this Privacy Policy.

We may update this privacy statement to reflect changes to our information practices. If we make any material changes we will notify you (sending an email specified in your account). However, we encourage you to periodically review this page for the latest information on our privacy practices. If you do not refuse the changes in writing before they become effective, this shall mean that you have consented to the Privacy Policy as changed. Your continued use of the Service after the revised Policy has become effective indicates that you have read, understood and agreed to the current version of the Policy.

4. International Visitors.

When you use the Services, you are consenting to have your data transferred to and processed in the United States. All of Mosyle’s servers are currently in the United States. Given this limitation, if your use of the Services or disclosure of certain information to Mosyle would violate any law that is applicable to you, your right to use the Services and/or disclose such information is revoked, as it is wherever use of the Services is prohibited by law (as described in the Terms of Services).


5. Newsletters

If you are a User, we may use your name and email address to send our newsletter to you. If you no longer wish to receive it, you can follow the instructions to unsubscribe contained in any of the emails you receive.


6. Other Sites

Mosyle does not control and is not responsible for the collection of your personal information by third party sites. We are not responsible for the practices and policies implemented by third parties on their websites, and this Privacy Policy does not cover them. Please, be aware that Mosyle is not responsible for the privacy practices of other sites. You should contact directly the owners of these websites to ask questions about the privacy policies and practices. Policies and practices present in this statement only apply over the information regarding the use of Mosyle’s Services.


7. Testimonials

We use some of the testimonies of our clients that may contain personal and identifying information. We obtain the consent of the Customer via email before making any reference to it. If you want your testimonial removed, please contact us at privacy@mosyle.com.


8. Language

In the event that Mosyle has provided you with a translation of the English language version of this Privacy Policy, then you agree that the translation is provided for your convenience only and that the English language version of the Privacy Policy rules your relationship with Mosyle; and, if there is any contradiction between what the English language version of the Privacy Policy and the translation says, the English language version shall take precedence.
